Company Envisions ‘Vaults’ for Personal Data

“YOU are walking around naked on the Internet and you need some clothes,” says Michael Fertik. “I am going to sell you some.”


Naked? Not exactly, but close.


Mr. Fertik, 34, is the chief executive of Reputation.com, a company that helps people manage their online reputations. From his perch here in Silicon Valley, he views the digital screens in our lives, the smartphones and the tablets, the desktops and the laptops, as windows of a house. People go about their lives on the inside, he says, while dozens of marketing and analytics companies watch through the windows, sizing them up like peeping Toms.


By now many Americans are learning that they are living in a surveillance economy. “Information resellers,” also known as “data brokers,” have collected hundreds to thousands of details — what we buy, our race or ethnicity, our finances and health concerns, our Web activities and social networks — on almost every American adult. Other companies that specialize in ranking consumers use computer algorithms to covertly score Internet users, identifying some as “high-value” consumers worthy of receiving pitches for premium credit cards and other offers, while dismissing others as a waste of time and marketing money. Yet another type of company, called an ad-trading platform, profiles Internet users and auctions off online access to them to marketers in a practice called “real-time bidding.”


As these practices have come to light, several members of Congress, and federal agencies, have opened investigations.


At least for now, however, these companies typically do not permit consumers to see the records or marketing scores that have been compiled about them. And that is perfectly legal.


Now, Mr. Fertik, the loquacious, lion-maned founder of Reputation.com, says he has the free-market solution. He calls it a “data vault,” or “a bank for other people’s data.”


Here at Reputation.com’s headquarters, a vast open-plan office decorated with industrial-looking metal struts and reclaimed wood — a discreet homage to the lab where Thomas Edison invented the light bulb — his company has amassed a database on millions of consumers. Mr. Fertik plans to use it to sell people on the idea of taking control of their own marketing profiles. To succeed, he will have to persuade people that they must take charge of their digital personas.


Pointing out the potential hazards posed by data brokers and the like is part of Mr. Fertik’s M.O. Covert online profiling and scoring, he says, may unfairly exclude certain Internet users from marketing offers that could affect their financial, educational or health opportunities — a practice Mr. Fertik calls “Weblining.” He plans to market Reputation.com’s data vault, scheduled to open for business early next year, as an antidote.


“A data privacy vault,” he says, “is a way to control yourself as a person.”


Reputation.com is at the forefront of a nascent industry called “personal identity management.” The company’s business model for its vault service involves collecting data about consumers’ marketing preferences and giving them the option to share the information on a limited basis with certain companies in exchange for coupons, say, or status upgrades. In turn, participating companies will get access both to potential customers who welcome their pitches and to details about the exact products and services those people are seeking. In theory, the data vault would earn money as a kind of authorization supervisor, managing the permissions that marketers would need to access information about Reputation.com’s clients.


To some, the idea seems a bit quixotic.


Reputation.com, with $67 million in venture capital, is not making a profit. Although the company’s “privacy” products, like removing clients’ personal information from list broker and marketing databases, are popular, its reputation management techniques can be controversial. For instance, it offers services meant to make negative commentary about individual or corporate clients less visible on the Web.


And there are other hurdles, like competition. A few companies, like Personal, have already introduced vault services. Also, a number of other enterprises have tried — and quickly failed — to sell consumers on data lockers.


Even so, Mr. Fertik contends Reputation.com has the answer. The company already has several hundred thousand paying customers, he says, and patents on software that can identify consumers’ information online and score their reputations. He intends to show clients their scores and advise them on how to improve them.


“You can’t just build a vault and wish that vendors cared enough about your data to pay for it,” Mr. Fertik says. “You have to build a business that gives you the lift to accumulate a data set and attract consumers, the science to create insights that are valuable to vendors, and the power to impose restrictions on the companies who consume your data.”


THE consumer data trade is large and largely unregulated.


Companies and organizations in the United States spend more than $2 billion a year on third-party data about individuals, according to a report last year on personal identity management from Forrester Research, a market research firm. They spend billions more on credit data, market research and customer data analytics, the report said.

The Human Price: Bangladesh Fire Exposes Safety Gap in Supply Chain





ASHULIA, Bangladesh — The fire alarm shattered the monotony of the Tazreen Fashions factory. Hundreds of seamstresses looked up from their machines, startled. On the third floor, Shima Akhter Pakhi had been stitching hoods onto fleece jackets. Now she ran to a staircase.

But two managers were blocking the way. Ignore the alarm, they ordered. It was just a test. Back to work. A few women laughed nervously. Ms. Pakhi and other workers returned to their sewing tables. She could stitch a hood to a jacket in about 90 seconds. She arranged the fabric under her machine. Ninety seconds. Again. Ninety more seconds. She sewed six pieces, maybe seven.


Then she looked up.


Smoke was filtering up through the three staircases. Screams rose from below. The two managers had vanished. Power suddenly went out throughout the eight-story building. There was nowhere to escape. The staircases led down into the fire. Iron grilles blocked the windows. A man cowering in a fifth-floor bathroom called his mother to tell her he was about to die.


“We all panicked,” Ms. Pakhi said. “It spread so quickly. And there was no electricity. It was totally dark.”


Tazreen Fashions Ltd. operated at the beginning of the global supply chain that delivers clothes made in Bangladesh to stores in Europe and the United States. By any measure, the factory was not a safe place to work. Fire safety preparations were woefully inadequate. The building itself was under construction — even as sewing work continued inside — and mounds of flammable yarn and fabric were illegally stored on the ground floor near electrical generators.


Yet Tazreen was making clothing destined for some of the world’s top retailers. On the third floor, where firefighters later recovered 69 bodies, Ms. Pakhi was stitching sweater jackets for C&A, a European chain. On the fifth floor, workers were making Faded Glory shorts for Walmart. Ten bodies were recovered there. On the sixth floor, a man named Hashinur Rahman put down his work making True Desire lingerie for Sears and eventually helped save scores of others. Inside one factory office, labor activists found order forms and drawings for a licensee of the United States Marine Corps that makes commercial apparel with the Marines’ logo.


In all, 112 workers were killed in a blaze last month that has exposed a glaring disconnect among global clothing brands, the monitoring system used to protect workers and the factories actually filling the orders. After the fire, Walmart, Sears and other retailers made the same startling admission: They say they did not know that Tazreen Fashions was making their clothing.


But who, then, is ultimately responsible when things go so wrong?


The global apparel industry aspires to operate with accountability that extends from distant factories to retail stores. Big brands demand that factories be inspected by accredited auditing firms so that the brands can control quality and understand how, where and by whom their goods are made. If a factory does not pass muster, it is not supposed to get orders from Western customers.


Tazreen Fashions was one of many clothing factories that exist on the margins of this system. Factory bosses had been faulted for violations during inspections conducted on behalf of Walmart and at the behest of the Business Social Compliance Initiative, a European organization.


Yet Tazreen Fashions received orders anyway, slipping through the gaps in the system by delivering the low costs and quick turnarounds that buyers — and consumers — demand. C&A, the European retailer, has confirmed ordering 220,000 sweaters from the factory. But much of the factory’s business came through opaque networks of subcontracts with suppliers or local buying houses. Labor activists, combing the site of the disaster, found labels, order forms, design drawings and articles of clothing from many global brands.


Walmart and Sears have since said they fired the suppliers that subcontracted work to Tazreen Fashions. Yet some critics have questioned how a company like Walmart, one of the two biggest buyers in Bangladesh and renowned for its sophisticated global supply system, could have been unaware of the connection.

For Medical Marijuana in New Jersey, a First Few Ounces

MONTCLAIR, N.J. — They skulked in and out like criminals, shoulders hunched, heads down, declining to comment.




It was the opening of New Jersey’s first and so far only medical marijuana dispensary, in downtown Montclair, on Thursday, nearly three years after the law allowing such enterprises was passed. The opening had been delayed by political battles over whether it would lead to the de facto legalization of marijuana.


Patronizing the dispensary was perfectly legal, provided a doctor’s prescription for a list of specified medical conditions was presented, yet the pioneering visitors — it was not clear if they were patients — seemed none too eager to declare themselves, perhaps taken aback by the horde of news reporters there to greet them. One visitor, who would give only a first name, Ed, said he had been in pain since being shocked on the job for an electric company in 2003.


Not for them the whimsicality of the Magical Mystery Tour and other happy drug allusions of the ’60s. The opening was all business, down to the pious name, the Greenleaf Compassion Center. Visits were by appointment only, and a uniformed security guard stood outside the front door at 395 Bloomfield Avenue, checking identifications before letting anyone into the store, which had black glass windows, making it all but impossible to see inside.


The operators of the dispensary did step out for a cigarette break, strictly tobacco.


The chief executive, Joseph Stevens, 40, said he had been a funeral director for 12 years in Nutley, where he was inspired to go into his current business by seeing firsthand the suffering of families whose relatives had died of painful diseases.


“It’s a comforting experience,” Mr. Stevens said, describing how patients had reacted to the dispensary. “They’ve lived in the shadows for so many years.” He said this was a place where they could get the therapy they needed yet “feel safe, have no fear of prosecution, and go home.”


His business partner, Julio Valentin Jr., 43, the chief operating officer, is a former Newark police officer who had run a Montclair establishment, the Café Eclectic, known for its funky ambience, up the street for 15 years.


Mr. Valentin said the town had been very welcoming, and stressed that the dispensary was “not going to be your typical head shop or mom-and-pop shop. This is a professional program.” He had designed the interior décor, which he described as “beautiful,” with “earth tones, a soothing atmosphere, leather couches, like an upscale doctor’s office.”


The partners said they had been friends for 32 years, and Mr. Stevens said they were growing the marijuana in a “very clean, very secure” warehouse. Asked if they had ever personally smoked their product, Mr. Stevens said, “No, I don’t. I just don’t like it,” but quickly added that if he were sick, that would be a different story.


Mr. Valentin gave a theatrical shrug and a sheepish smile.


They said they received several patients Thursday and dispensed between a half ounce and two ounces of marijuana to each of them. Two inspectors from the State Health Department also paid a monitoring visit.


Montclair is known as a suburban version of Park Slope, Brooklyn, a town with an haute bohemian feel, home to many writers and journalists. But the dispensary is in a down-at-the-heels section of the commercial strip reserved for offbeat and pariah businesses: a string of ethnic restaurants; a cigar lounge; a head shop with an adults-only section in back; and right next door, an abortion clinic with a forbidding concrete facade.


Passers-by reacted mostly enthusiastically to the dispensary on its first day.


Looking on in fascination, Francis David Robinson, or F.D.R., as he likes to be called, a debonair 74-year-old who runs errands for tips, said, “Could I get a freebie?”


Told that his glaucoma was one of the conditions that could qualify, along with diseases like terminal cancer and muscular dystrophy, he said dismissively, “I hate doctors.”


One person unabashedly rejoiced in the arrival of the dispensary. Surrounded by colorful glass bongs, Candi Cooper, the manager of the combination head shop and adult shop, called the Montclair Video Boutique, with peace signs in every “O” in its name on the sign out front, said she looked forward to a fruitful relationship.


“It’s kind of like a hospital,” she said, of the dispensary. “You get morphine and Dilaudid at the hospital. Does that make the place that sells medical equipment to put the morphine in a bad thing? No.”

Gadgetwise Blog: How to Restore Old iTunes Features to New iTunes

The revamped iTunes — iTunes 11 — has been lauded for its spare design and for taking what some iTunes users have called a bloated program back to the basics.

But other people may miss classic elements that have disappeared. The good news is that not all of them are really gone. Some are just hidden or renamed. You can get those back easily if you want to. Below are a few examples. (Other features that few people — except me, apparently — had used, such as cover flow and the ability to open multiple iTunes windows, are unlikely to reappear, said Apple.)

The most obvious loss is the sidebar, the vertical column that used to appear on the left side of the iTunes screen, giving easy access to things like playlists, TV selections and movies. To bring it back, go to the very top toolbar and click the View tab. That opens a drop-down menu. The fifth choice from the top is Show Sidebar. Choose it and the sidebar will reappear.

The iTunes DJ has been replaced by Up Next. At the top of your iTunes window in the center is a box with album art and song information. On the right of that box is the icon for a list – it’s a square of dots and stripes that looks a little like a flag. Click it and you see a list of upcoming songs, similar to DJ. Hold the cursor over a song to make controls appear that will let you remove that song from the list or get more information. You can also drag the song to a different position on the playlist. Or from your main music menu, right-click (control-click on Mac) a song to add it to the Up Next list.

Also missing is the little box in the lower left where album art used to show. It was useful because you could drag a picture into the box to manually fill in missing album covers. Now to manually add art, you need to “Get Info” on the song. Highlight the song you want, click on File in the tool bar for the drop-down menu, and Get Info will be the tenth item down. Or you can use a keyboard shortcut by right-clicking on the song (or on Mac, control-click).

The Find Duplicates button — which helped you discover when you had two copies of a song in your library — is likely to reappear in the future, said Apple, but if you can’t live a day without that feature, there are apps for sale, such as TuneUp for the Mac and dupeGuru for Mac, Linux and Windows.

Senate Passes Russian Trade Bill, With Conditions


The Senate voted on Thursday to finally eliminate cold war-era trade restrictions on Russia, but at the same time it condemned Moscow for human rights abuses, threatening to further strain an already fraught relationship with the Kremlin.


The Senate bill, which passed the House of Representatives last month, now goes to President Obama, who has opposed turning a trade bill into a statement on the Russian government’s treatment of its people.


But with such overwhelming support in Congress – the measure passed the Senate 92 to 4 and the House 365 to 43 – the White House has had little leverage to press its case.


And President Obama has shown little desire to pick a fight in which he would appear to be siding with the Russians on such a delicate issue.


Speaking to reporters shortly after the Senate vote, Jay Carney, the White House press secretary, said the president was committed to signing the bill.


The most immediate effect of the bill will be to formally normalize trade relations with Russia after nearly 40 years. Since the 1970s, commerce between Russia and the United States has been subject to restrictions that were designed to punish Communist nations that refused to allow their citizens to leave freely.


While presidents have waived the restrictions since the cold war ended — allowing them to remain on the books as a symbolic sore point with the Russians — the issue took on new urgency this summer after Russia joined the World Trade Organization. American businesses can take advantage of lower trade tariffs only with nations that enjoy normalized trade status


By some estimates, trade with Russia is expected to double after the limits are lifted.


But another effect of the bill – and one that has Russian officials furious with Washington – will be to require that the federal government freeze the assets of Russians implicated in human rights abuses and to deny them visas.


Lawmakers on Capitol Hill were inspired to attach those provisions to the trade legislation because of the case of Sergei L. Magnitsky, a Russian lawyer who was tortured and died in prison in 2009 after he exposed a government tax fraud scheme.


During the Senate debate, it was Mr. Magnitsky’s case, and not Russia’s trade status, that occupied most of the time.


One by one, Democratic and Republican senators alike rose to denounce Russian officials for their disregard for basic freedoms.


“This culture of impunity in Russia has been growing worse and worse,” said Senator John McCain, an Arizona Republican. “There are still many people who look at the Magnitsky Act as anti-Russia. I disagree,” he added. “Ultimately passing this legislation will place the United States squarely on the side of the Russian people and the right side of Russian history, which appears to be approaching a crossroads.”


Russian officials denounced the Senate vote.


“This initiative is intended to restrict the rights of Russian citizens, which we consider completely unjust and baseless,” said Konstantin Dolgov, the Russian foreign ministry’s human rights envoy, in comments to the Interfax news agency in Brussels. “This is an attempt to interfere in our internal affairs, in the authority of Russia’s investigative and judicial organs, which continue to investigate the Magnitsky case.”


Initially there was pressure on the Senate to pass a bill that punished human rights violators from all nations, not just those who are Russian. But the House bill applied only to Russia. And the Senate followed suit, as supporters of the bill wanted something that could pass quickly and not require a complicated back-and-forth with the House.

Well: Running in Reverse

Backward running, also known as reverse or retro running, is not as celebrated as barefoot running and will never be mistaken for the natural way to run. But a small body of science suggests that backward running enables people to avoid or recover from common injuries, burn extra calories, sharpen balance and, not least, mix up their daily routine.

The technique is simple enough. Most of us have done it, at least in a modified, abbreviated form, and probably recently, perhaps hopping back from a curb as a bus went by or pushing away from the oven with a roasting pan in both hands. But training with backward running is different. Biomechanically, it is forward motion’s doppelgänger. In a study published last year, biomechanics researchers at the University of Milan in Italy had a group of runners stride forward and backward at a steady pace along a track equipped with force sensors and cameras.

They found that, as expected, the runners struck the ground near the back of their feet when going forward and rolled onto the front of their feet for takeoff. When they went backward though, they landed near the front of their feet and took off from the heels. They tended to lean slightly forward even when running backward. As a result, their muscles fired differently. In forward running, the muscles and tendons were pulled taut during landing and responded by coiling, a process that creates elastic energy (think rubber bands) that is then released during toe-off. When running backward, muscles and tendons were coiled during landing and stretched at takeoff. The backward runners’ legs didn’t benefit from stored elastic energy. In fact, the researchers found, running backward required nearly 30 percent more energy than running forward at the same speed. But backward running also produced far less hard pounding.

What all of this means, says Giovanni Cavagna, a professor at the University of Milan who led the study, is that reverse running can potentially “improve forward running by allowing greater and safer training.”

It is a particularly attractive option for runners with bad knees. A 2012 study found that backward running causes far less impact to the front of the knees. It also burns more calories at a given pace. In a recent study, active female college students who replaced their exercise with jogging backward for 15 to 45 minutes three times a week for six weeks lost almost 2.5 percent of their body fat.

And it aids in balance training — backward slow walking is sometimes used as a therapy for people with Parkinson’s and is potentially useful for older people, whose balance has grown shaky.

But it has drawbacks, Cavagna says — chiefly that you can’t see where you’re going. “It should be done on a track,” he says, “or by a couple of runners, side by side,” one facing forward.

It should be implemented slowly too, because its unfamiliar motion can cause muscle fatigue. Intersperse a few minutes periodically during your regular routine, Cavagna says. Increase the time you spend backward as it feels comfortable.

The good news for serious runners is that backward does not necessarily mean slow. The best recorded backward five-kilometer race time is 19:31, faster than most of us can hit the finish line with our best foot forward.

And it aids in balance training — backward slow walking is sometimes used as a therapy for people with Parkinson’s and is potentially useful for older people, whose balance has grown shaky.

But it has drawbacks, Cavagna says — chiefly that you can’t see where you’re going. “It should be done on a track,” he says, “or by a couple of runners, side by side,” one facing forward.

It should be implemented slowly too, because its unfamiliar motion can cause muscle fatigue. Intersperse a few minutes periodically during your regular routine, Cavagna says. Increase the time you spend backward as it feels comfortable.

The good news for serious runners is that backward does not necessarily mean slow. The best recorded backward five-kilometer race time is 19:31, faster than most of us can hit the finish line with our best foot forward.

Apple to Resume U.S. Manufacturing





For the first time in years, Apple will manufacture computers in the United States, the chief executive of Apple, Timothy D. Cook, said in interviews with NBC and Bloomberg Businessweek.




“Next year, we will do one of our existing Mac lines in the United States,” he said in an interview to be broadcast Thursday on “Rock Center With Brian Williams” on NBC.


Apple, the biggest company in the world by market value, moved most of its manufacturing to Asia in the late 1990s. As an icon of American technology success and innovation, the California-based company has been criticized in recent years for outsourcing jobs abroad.


“I don’t think we have a responsibility to create a certain kind of job,” Mr. Cook said in the Businessweek interview. “But I think we do have a responsibility to create jobs.”


The company plans to spend $100 million on the American manufacturing in 2013, according to the interviews, a small fraction of its overall factory investments and an even tinier portion of its available cash.


In the interviews, Mr. Cook suggested the company would work with partners and that the manufacturing would be more than just the final assembly of parts. He noted that parts of the company’s ubiquitous iPhone, including the “engine” and the glass screen, were already made in America. The processor is manufactured by Samsung in Texas, while Corning makes the glass screen in Kentucky.


Over the last few years, sales of the iPhone, iPod and iPad have overwhelmed Apple’s line of Macintosh computers, the basis of the company’s early business. Revenue from the iPhone alone made up 48 percent of the company’s total revenue for its fiscal fourth quarter ended Sept. 30.


But as recently as October, Apple introduced a new, thinner iMac, the product that pioneered the technique of building the computer innards inside the flat screen.


Mr. Cook did not say in the interviews where in the United States the new manufacturing would occur. But he did defend Apple’s track record in American hiring.


“When you back up and look at Apple’s effect on job creation in the United States, we estimate that we’ve created more than 600,000 jobs now,” Mr. Cook told Businessweek. Those jobs include positions at partners and suppliers.


Steve Dowling, a spokesman for Apple, declined on Thursday to provide additional details on Apple’s plans, referring to Mr. Cook’s interviews.


Apple has for years done the final assembly of some Macs in the United States, mainly systems that customers buy with custom configurations, like bigger hard drives and more memory than on standard machines.


Mr. Cook’s statements suggested Apple is planning to build more of the Mac’s ingredients domestically, although with partners. He told Businessweek that the plan “doesn’t mean that Apple will do it ourselves, but we’ll be working with people, and we’ll be investing our money.”


While Apple’s products are typically made in Asian factories owned by other companies, Apple itself often purchases the sophisticated manufacturing equipment required to make its cutting-edge designs, spending billions of dollars a year on such machines.


Foxconn Technology, which manufactures more than 40 percent of the world’s electronics, is one of Apple’s main overseas manufacturing contractors. Based in Taiwan, Foxconn is China’s largest private employer, with 1.2 million workers, and it has come under intense scrutiny over working conditions inside its factories.


In March, Foxconn pledged to sharply curtail the number of working hours and significantly increase wages. The announcement was a response to a far-ranging inspection by the Fair Labor Association, a monitoring group that found widespread problems — including numerous instances where Foxconn violated Chinese law and industry codes of conduct.


Apple, which recently joined the labor association, had asked the group to investigate plants manufacturing iPhones, iPads and other devices. A growing outcry over conditions at overseas factories prompted protests and petitions, and several labor rights organizations started scrutinizing Apple’s suppliers.


Almost all of the 70 million iPhones, 30 million iPads and 59 million other products Apple sold in 2011 were manufactured overseas. Apple employs 43,000 people in the United States and 20,000 overseas. An additional 700,000 people engineer, build and assemble iPads, iPhones and Apple’s other products, mostly abroad.


At a meeting with Silicon Valley executives in 2011, President Obama asked Steven P. Jobs, then the Apple chief executive, what it would take to make iPhones in the United States. Mr. Jobs, who died later that year, told the president, “Those jobs aren’t coming back.”

India’s Lower House Votes to Support Foreign Investment





NEW DELHI — India’s lower house of Parliament voted in a raucous session on Wednesday evening to support the government’s decision to allow Walmart and other major retailers to set up shop here.

The nationally televised debate featured some of India’s best orators and most powerful politicians in a high-profile fight that could serve as the opening bell for a series of elections that start next week in the western state of Gujarat. The elections will culminate in 2014 when control over India’s central government will be determined.


Television cameras routinely focused on Sonia Gandhi, a scion of the country’s most powerful family, as she nodded or frowned during crucial portions of the debate. Mrs. Gandhi is the president of the Indian National Congress Party, the dominant member of a coalition that has controlled the central government since 2004.


In September, the government had approved several changes, one of which provided for increased foreign investment in India’s retail sector, the policy under debate Wednesday.


Those changes were cheered by investors and foreign governments but have been contentious in India, where decades of paternalistic and protectionist economic policies still garner considerable support. India’s once fast-growing economy has slowed considerably this year, and the government is hoping the measures will help jump-start growth.


While it riveted the nation, the debate had more symbolic than practical importance. The government had announced that it would go forward with its decision to open foreign investment regardless of how Parliament voted. It won Wednesday’s vote, 253 to 218, partly because members of two of its allied parties, whose leaders said they opposed the policy, were among the more than 40 members of the lower chamber who walked out before the voting, largely to deny a victory to the opposition. Prospects for approval in the upper house of Parliament are less certain.


The debate grew comical when Sushma Swaraj, the leader of the opposition in the lower house, said that McDonalds was importing potatoes used for its French fries because Indian potatoes were deemed to be too small. McDonalds India responded that it bought its potatoes locally, and a member of Parliament who supported the government noted that farmers in a state ruled by Ms. Swaraj’s party supplied potatoes to McDonalds.


The government’s victory was a blow to the Bharatiya Janata Party, the main opposition party, which lost the vote even though a majority of members of the lower house had expressed resistance to the underlying policy. The party has been linked with anti-Muslim actions and sentiments, so regional parties that rely on Muslim votes have been reluctant to support its positions.


India’s electoral politics have become so intensely competitive that few parties are willing to offend Muslims by being linked with the Bharatiya Janata Party. The strength of the distaste for the Bharatiya Janata Party that was demonstrated Wednesday could spell problems for the party in the lead-up to the 2014 elections, when regional parties are expected to gain even more power.

Blue-Chip Shares Jump





Blue-chip stocks rebounded on Wall Street on Wednesday, with 4 percent gains in Travelers and Hewlett-Packard leading the way.


The Dow Jones industrial average jumped 0.9 percent, or about 110 points, in afternoon trading. The broader Standard & Poor’s 500-stock index added 0.4 percent, while the technology-heavy Nasdaq composite index fell 0.5 percent.


In economic reports, data showed that private-sector employers in the United States added 118,000 jobs in November, shy of economists’ expectations.


Apple shares were down 4 percent and accounted for a chunk of the Nasdaq sell-off. Market participants cited a consulting firm’s report about the company losing share in the tablet market, and reports that margin requirements had been raised by at least one clearing firm.


Freeport-McMoRan Copper & Gold said it would acquire Plains Exploration & Production and McMoRan Exploration for $9 billion in cash and stock in a major expansion into energy. Freeport shares were off 13.4 percent.


Walt Disney gave a much-needed boost to Netflix, becoming the first major Hollywood studio to use the video service to bypass premium channels like HBO that traditionally controlled the delivery of movies to TV subscribers. Netflix shares were down 1.6 percent after a 14 percent jump on Tuesday.


In Europe, shares closed mixed. The FTSE 100 index in London rose 0.2 percent.


The new chief of the Chinese Communist Party, Xi Jinping, said the country would maintain its fine-tuning of economic policies in 2013 to ensure stable economic growth. That sparked a rally in Chinese shares, with the Shanghai composite index surging 2.9 percent.


“Investors’ bullish receptors were earlier tickled by overnight events in China, where the new leadership announced a drive toward ‘urbanization’, which means more infrastructure investment,” said Andrew Wilkinson, chief economic strategist at Miller Tabak & Co. in New York.


Nokia is to partner with China Mobile, the world’s biggest cellular service operator, to introduce a version of its flagship Lumia smartphone tailored for the world’s largest market. Wall Street-listed shares of Nokia rose 6 percent.


Wall Street equities finished slightly lower in quiet trading Tuesday as the back-and-forth wrangling in Washington over the government budget gave investors little reason to act.

Half a century ago, as a rapidly changing world sought increasingly smaller mechanical and electrical components and more sanitary hospital conditions, one of the biggest obstacles to progress was air, and the dust and germs it contains.


Stray particles a few microns wide could compromise the integrity of a circuit board of a nuclear weapon. Unchecked bacteria could quickly infect a patient after a seemingly successful operation. Microprocessors, not yet in existence, would have been destroyed by dust. After all, an average cubic foot of air contained three million microscopic particles, and even the best efforts at vacuuming and wiping down a high-tech work space could only reduce the rate to one million.


Then, in 1962, Willis Whitfield invented the clean room.


“People said he was a fraud,” recalled Gilbert V. Herrera, the director of microsystems science and technology at Sandia National Laboratories in Albuquerque. “But he turned out to be right.”


Mr. Whitfield, who worked at Sandia from 1954 to 1984, died on Nov. 12 in Albuquerque. He was 92. The cause was prostate cancer, his wife, Belva, said.


His clean rooms blew air in from the ceiling and sucked it out from the floor. Filters scrubbed the air before it entered the room. Gravity helped particles exit. It might not seem like a complicated concept, but no one had tried it before. The process could completely replace the air in the room 10 times a minute.


Particle detectors in Mr. Whitfield’s clean rooms started showing numbers so low — a thousand times lower than other methods — that some people did not believe the readings, or Mr. Whitfield. He was questioned so much that he began understating the efficiency of his method to keep from shocking people.


“I think Whitfield’s wrong,” a scientist from Bell Labs finally said at a conference where Mr. Whitfield spoke. “It’s actually 10 times better than he’s saying.”


Willis James Whitfield was born in Rosedale, Okla., on Dec. 6, 1919. In addition to his wife, his survivors include his sons, James and Joe; a sister, Amy Blackburn; and a brother, Lawrence.


Mr. Whitfield became fascinated with electronics as a young man and received a two-year degree in the field after high school. He served in the Navy late in World War II, working with experimental electronic systems for aircraft. In 1952, he received a bachelor’s degree in physics and math from Hardin-Simmons University in Abilene, Tex.


By 1954 he was working at Sandia, which was involved in making parts for nuclear weapons and at the time was overseen by the Atomic Energy Commission. Mr. Whitfield’s duties soon included contamination control. By 1960, he had established his basic idea for the clean room.


“I thought about dust particles,” Mr. Whitfield told Time magazine in 1962. “Where are these rascals generated? Where do they go?”


The clean room was patented through Sandia, and the government shared it freely among manufacturers, hospitals and other industries.


Mr. Whitfield’s original clean room was only about six feet high, built as a small, self-contained unit. Some modern electronic devices, including the iPhone, are now built in China in huge clean rooms in structures that are more than a million square feet. Workers wear protective clothing, and other anticontamination methods have been added, but they still depend on Mr. Whitfield’s approach to suck up dust.


“Relative to these electronics, the particles are just massive boulders that would short out all of your electronics and make them not work,” Mr. Herrera said. “The core technology, just the cleaning part, hasn’t really changed a lot.”


Mrs. Whitfield said she was often been asked if her husband was a particularly fastidious man, and she always noted that he tended not to put his shoes away. Here’s an odd one. Little Inferno is an interactive fireplace. It’s an emotional, interactive fireplace with a story line and some notions about the dangers of amusing ourselves with distracting trifles.


At first this strange creation appears to be a simple puzzle game consisting of little more than a fireplace, a catalog of items to burn and 99 clues that challenge the player to burn these things in proper combinations. One clue is “Movie Night.” Burn the popcorn. Burn the TV. A weirder one is “Bike Pirate.” Burn the wooden bike. Burn the pirate.


As you play, an unseen character begins to send letters. They burn, too, but something seems off. The messages are alternately cheerful and sad, a wee bit wicked and increasingly desperate.


The purpose of the pyromaniac pastime becomes smoky with doubt. Why are we doing this? What are we missing? It’s odd enough to play a new video game that questions our decision to play video games. That it’s an interactive fireplace game that does this is all the stranger and more wonderful. It’s a yule log for our times.

It’s a vile, dangerous world in Hitman: Absolution. Nearly everyone is in need of a good killing, and Agent 47, the depilated murder machine at the center of the long-running Hitman franchise, is just the man for the job.


Absolution is consistent with the setup of past Hitman games: At the start of a level, 47 is given an assassination target, and he must make his way through semi-open areas by any of a number of possible routes. The reactive artificial intelligence keeps things enjoyably unpredictable, and the best levels feel like a buffet of sadistic improvisation.


The story is pure B-movie hogwash. It’s mostly enjoyable in a certain exploitive way, but it often feels as if the writers were trying too hard.


When it gets cooking, Hitman: Absolution evokes the feeling of a deadly, measured dance. It’s a tango between you and the computer, with each party alternately taking the lead through arenas that shift and upset expectations.

Assassin’s Creed III is really the fifth major Assassin’s Creed game. The numbering signifies that this new historical epic is a shift, as this Ubisoft series about the ancestral lives of a man named Desmond Miles leaps to its third era. Finished with the 12th-century crusades and 15th-century Renaissance Italy, Assassin’s Creed now lets us do interactive historical tourism in Boston, New York and the nearby woods of Revolutionary America.


Assassin’s Creed games are lavish action-adventure blockbusters. In this new one, we primarily play as a young, bitter, half-British, half-Mohawk greenhorn assassin named Ratonhnhaké:ton, who finds himself crossing paths and sometimes doing the bidding of Sam Adams, Paul Revere, George Washington and other real figures. Most of the bad guys are red coats with slow-firing muskets. We’re best with a tomahawk and a bow and arrow.


The new game involves a lot of climbing and killing across a sprawling landscape of bustling cities and gorgeous frontier. Add in a mix of awkwardly instituted horseback riding, homestead building, trading, trapping, hunting and, at the wheel of your own tall-masted warship, epic naval combat. There is much to do and witness in a ripped-from-the-history-books adventure that is refreshingly unwilling to ignore the unsavory aspects of America’s birth. A lengthy production cycle didn’t spare the game from a wealth of bugs that are only now being patched out.


The series’s low-key multiplayer games of competitive assassination return, but the star of this epic is something that might seem almost quaint: Assassin’s Creed III is easily the best tree-climbing simulator in history.

Port-Au-Prince Journal: Campaign in Haiti to Close Orphanages

PORT-AU-PRINCE, Haiti — Orphanages packed with little ones dot the landscape here, some with brightly colored signs outside their gates, others unmarked on back roads. But many of the children are not actually orphans, and a campaign is under way to close as many of the institutions as possible for good.




In the courtyard of one, Chris Savini, a missionary from Illinois, rocked a 10-month-old boy to sleep. The infant’s mother had died, and his father, Luxe Étienne, overwhelmed with eight children, turned over six of them to orphanages.


“He knew it was his son’s best shot,” said Mr. Savini, who arranged with the father for an American couple to adopt the baby from Mission Une Seule Famille en Jésus Christ, on the outskirts of Port-au-Prince.


Such arrangements have long been commonplace here. After the earthquake in 2010, it became clear that most children in the hundreds of orphanages in Haiti have living parents, as 10 Americans were jailed for taking custody of 33 children they said they believed to be orphans and trying to cross into the Dominican Republic with them. All the children were subsequently found to have parents living in Haiti.


Since then, a consensus has developed among government officials, children’s advocates, religious leaders and others that a new approach is required, starting with a reduction in the number of orphanages. But the transition is not easy, and some question whether the country is ready for it.


Of the roughly 30,000 children in Haitian institutions and the hundreds adopted by foreigners each year, the Haitian government estimates that 80 percent have at least one living parent.


The decision by Haitian parents to turn their children over to orphanages is motivated by dire poverty. Also, large families are common, and many parents unable to afford school fees believe that orphanages at least offer basic schooling and food.


On a recent visit to the orphanage caring for three of his children, Mr. Étienne said he struggled to make a living as a contractor and could barely support his two children who remained at home. Their private school fees, the equivalent of $237 per year, add to his burden.


“If I had enough income, I would have taken them back home,” he said, holding his cooing son.


Under rules put in place last month to comply with the Hague Convention on Intercountry Adoptions, the Haitian government intends to play a larger role in regulating adoptions. In cases involving children who are not orphans, the government intends to meet with the birth parents at the beginning of the process to obtain their consent and offer assistance like job training if they want their children to stay with them.


“We don’t want poverty to be the only motivation,” said Arielle Jeanty Villedrouin, who took charge of Haiti’s child welfare services last year. “For many cases in the past, that was the only motivation.”


To reduce the number of orphanages, the government has also begun inspecting institutions here in the capital and in the far-flung provinces and trying to close those in the worst shape and reunite as many children as possible with their families. A vast majority of the orphanages are unauthorized, and only 112 are accredited. Before this year, the government did not even have a count of the institutions.


Mission Une Seule Famille en Jésus Christ, where Mr. Étienne’s son awaits adoption, opened in 2005, but its director, Joseph Kesnel, said he picked up an application for accreditation only in October. Inspectors had not yet visited the orphanage, but there were troubling signs, including children complaining of not having enough to eat, a smell of urine and a baby without a diaper in the dirt courtyard.


With a team of 160 inspectors, financed in part by Unicef, the government has reviewed 725 orphanages and has found 72 to be of such poor quality that they should close. But actually shuttering them is another matter. Since September 2011, only 26 have been closed.


When one orphanage, Soeurs Rédemptrices de Nazareth, in the hills outside Port-au-Prince, was closed in June, 3 of the 64 children had to be hospitalized because of malnourishment, officials said, and others showed signs of rat bites and scabies. The director, Sister Dona Bélizaire, has been jailed on suspicion of child trafficking. Her backers have started an Internet campaign asserting that she is being held without cause.


The closings, though, have halted, because there are so few authorized orphanages that can take in children while the government tracks down their families, said Mrs. Villedrouin, the child welfare official.

Republicans Balk at Obama’s Short-Term Stimulus





WASHINGTON — Republicans and Democrats are struggling to find common ground on a long-term debt deal. But as economic growth has weakened this quarter, they are at odds over what the flagging recovery needs in the immediate future, too.




The Obama administration is arguing that the sluggish economy requires a shot in the arm, and it included tens of billions of dollars of little-noticed stimulus measures in its much-noticed proposal to Congressional leaders last week. But Republicans have countered that the country cannot afford to widen the deficit further, and have balked at including the measures in any eventual deal.


The stimulus measures in the White House’s debt proposal stem from President Obama’s long-since-scuttled American Jobs Act proposal, and include a continuation of emergency support for long-term unemployed workers, an extension of the payroll tax cut, billions in infrastructure investment and a mortgage-refinancing proposal.


“We have a very good plan, a very good mix of tax reforms” and savings, said Timothy F. Geithner, the Treasury secretary, on ABC News last weekend. “We can create some room to invest in things that make America stronger, like rebuilding America’s infrastructure.”


But in his counteroffer, made on Monday, House Speaker John A. Boehner of Ohio did not mention any such measures. Republican aides said that securing stimulus was not the main priority given concerns about the country’s fiscal state, and they appeared to be holding back on supporting any stimulus measures to bolster their bargaining position.


“The president is asking for $1.6 trillion worth of new revenue over 10 years, twice as much as he has been asking for in public,” Mr. Boehner said on “Fox News Sunday.” “He has stimulus spending in here that exceeded the amount of new cuts that he was willing to consider. It was not a serious offer.”


As the debate rages in Washington, data has shown the recovery once again sputtering, with the underlying rate of growth too slow to bring down the unemployment rate by much and some of the economic momentum gained in the fall dissipating in the winter.


The weakness comes from the manufacturing and exports slowdown, disruptions from Hurricane Sandy and sluggish underlying wage and spending growth. The storm hit the economic juggernauts of New Jersey and New York hard, pushing down work and wages. On top of that, consumers and businesses might be holding back out of concern for the tax increases and spending cuts scheduled to take place at the first of the year unless Congress and the administration come to some agreement.


In recent weeks, many forecasters have slashed their estimates of growth in the fourth quarter. Macroeconomic Advisers, for instance, estimates the economy is expanding at only a 0.8 percent annual pace, down from 2.8 percent in the third quarter.


“It’s a pretty dramatic slowdown,” said Joel Prakken, the chairman of Macroeconomic Advisers, the St. Louis-based forecasting firm. “There’s weak demand, which just does not portend well for the coming quarters,” he said.


RBC Capital Markets put the current pace of growth at just a 0.2 percent annual rate. The chance of seeing “a negative sign in front of fourth-quarter gross domestic product is nontrivial, to say the least,” Tom Porcelli, chief United States economist at RBC Capital Markets, wrote in a note to clients last week.


If Congress and the Obama administration are able to agree on a budget deal, economists expect that economic growth will pick up in 2013. Stock markets might cheer, businesses might feel more confident about hiring workers and signing contracts and investors might feel more comfortable investing if Congress struck a deal.


The turnaround in the housing market, rising auto sales and higher consumer confidence all bode well, they note. Refinancing — supported by the Federal Reserve’s effort to buy mortgage-backed securities — would also flush more money into households.


Much of the current slowdown might be a result of temporary factors that might fade away, like fluctuations in how factories stock their inventories or the lingering effects of Hurricane Sandy.


Still, recent economic data has come in surprisingly weak. On Monday, the Institute for Supply Management reported that the manufacturing sector contracted in November, with an index of purchasing activity falling to the lowest level since mid-2009.


The report said manufacturers expressed “concern over how and when the fiscal cliff issue will be resolved” as well as a slowdown in demand.


Over all, unemployment remains high, and wage growth weak. Global growth has gone through a slowdown as well. It all adds up to a United States recovery that might remain vulnerable to shocks — like the Midwestern drought that slashed agricultural production this year, or the Japanese tsunami that depressed exports in 2011, or the long-simmering European debt crisis that has spooked financial markets — for years to come.


Economists remain nervous about the combination of the already weak recovery and the prospect of the tax increases and spending cuts — with billions of dollars of fiscal contraction likely to take place even if the White House and Congress reach a deal.


“We are worried about going too fast, too quick on the cuts side,” said former Senator Pete V. Domenici, Republican of New Mexico, on Monday at a meeting with reporters at the Bipartisan Policy Center. He was presenting a plan for a deficit reduction framework along with Alice M. Rivlin, the budget director under President Bill Clinton.


Ms. Rivlin added, “We don’t need an austerity budget.” Indeed, the two budget experts proposed including a one-year income tax rebate to give the recovery some breathing room.

At last he spoke. “Lymphoma with secondary hemophagocytic syndrome,” he said. The crowd erupted in applause.


Professionals in every field revere their superstars, and in medicine the best diagnosticians are held in particularly high esteem. Dr. Gurpreet Dhaliwal, 39, a self-effacing associate professor of clinical medicine at the University of California, San Francisco, is considered one of the most skillful clinical diagnosticians in practice today.


The case Dr. Dhaliwal was presented, at a medical  conference last year, began with information that could have described hundreds of diseases: the patient had intermittent fevers, joint pain, and weight and appetite loss.


To observe him at work is like watching Steven Spielberg tackle a script or Rory McIlroy a golf course. He was given new information bit by bit — lab, imaging and biopsy results. Over the course of the session, he drew on an encyclopedic familiarity with thousands of syndromes. He deftly dismissed red herrings while picking up on clues that others might ignore, gradually homing in on the accurate diagnosis.


Just how special is Dr. Dhaliwal’s talent? More to the point, what can he do that a computer cannot? Will a computer ever successfully stand in for a skill that is based not simply on a vast fund of knowledge but also on more intangible factors like intuition?


The history of computer-assisted diagnostics is long and rich. In the 1970s, researchers at the University of Pittsburgh developed software to diagnose complex problems in general internal medicine; the project eventually resulted in a commercial program called Quick Medical Reference. Since the 1980s, Massachusetts General Hospital has been developing and refining DXplain, a program that provides a ranked list of clinical diagnoses from a set of symptoms and laboratory data.


And I.B.M., on the heels of its triumph last year with Watson, the Jeopardy-playing computer, is working on Watson for Healthcare.


In some ways, Dr. Dhaliwal’s diagnostic method is similar to that of another I.B.M. project: the Deep Blue chess program, which in 1996 trounced Garry Kasparov, the world’s best player at the time, to claim an unambiguous victory in the computer’s relentless march into the human domain.


Although lacking consciousness and a human’s intuition, Deep Blue had millions of moves memorized and could analyze as many each second. Dr. Dhaliwal does the diagnostic equivalent, though at human speed.


Since medical school, he has been an insatiable reader of case reports in medical journals, and case conferences from other hospitals. At work he occasionally uses a diagnostic checklist program called Isabel, just to make certain he hasn’t forgotten something. But the program has yet to offer a diagnosis that Dr. Dhaliwal missed.


Dr. Dhaliwal regularly receives cases from physicians who are stumped by a set of symptoms. At medical conferences, he is presented with one vexingly difficult case and is given 45 minutes to solve it. It is a medical high-wire act; doctors in the audience squirm as the set of facts gets more obscure and all the diagnoses they were considering are ruled out. After absorbing and processing scores of details, Dr. Dhaliwal must commit to a diagnosis. More often than not, he is right.


When working on a difficult case in front of an audience, Dr. Dhaliwal puts his entire thought process on display, with the goal of “elevating the stature of thinking,” he said. He believes this is becoming more important because physicians are being assessed on whether they gave the right medicine to a patient, or remembered to order a certain test.


Without such emphasis, physicians and training programs might forget the importance of having smart, thoughtful doctors. “Because in medicine,” Dr. Dhaliwal said, “thinking is our most important procedure.”


He added: “Getting better at diagnosis isn’t about figuring out if someone has one rare disease versus another. Getting better at diagnosis is as important to patient quality and safety as reducing medication errors, or eliminating wrong site surgery.”


Clinical Precision


Dr. Dhaliwal does half his clinical work on the wards of the San Francisco V. A. Medical Center, and the other half in its emergency department, where he often puzzles through multiple mysteries at a time.


One recent afternoon in the E.R., he was treating a 66-year-old man who was mentally unstable and uncooperative. He complained of hip pain, but routine lab work revealed that his kidneys weren’t working and his potassium was rising to a dangerous level, putting him in danger of an arrhythmia that could kill him — perhaps within hours. An ultrasound showed that his bladder was blocked.


There was work to be done: drain the bladder, correct the potassium level. It would have been easy to dismiss the hip pain as a distraction; it didn’t easily fit the picture. But Dr. Dhaliwal’s instinct is to hew to the ancient rule that physicians should try to come to a unifying diagnosis. In the end, everything — including the hip pain — was traced to metastatic prostate cancer.


“Things can shift very quickly in the emergency room,” Dr. Dhaliwal said. “One challenge of this, whether you use a computer or your brain, is deciding what’s signal and what’s noise.” Much of the time, it is his intuition that helps figure out which is which.
